1. Acceptance of Terms

By accessing or using EarlyBirder ("the Service") at earlybirder.com, you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. You must be at least 18 years old to use EarlyBirder.

2. Description of Service

EarlyBirder is a housing listing aggregator that collects and displays rental listings sourced from Craigslist across Southern California. We provide Early Bird Alerts that notify subscribers via email when new listings matching their criteria are posted. EarlyBirder is an independent service and is not affiliated with, endorsed by, or sponsored by Craigslist.

3. Subscription and Payment

Access to Early Bird Alerts and other member features requires a paid subscription at $9.99 per month. Subscriptions are billed monthly and renew automatically until cancelled. You may cancel your subscription at any time through your account billing page or by contacting support.

Refund Policy: All subscription fees are non-refundable. If you cancel, you retain access to paid features through the end of your current billing period. We do not offer prorated refunds for partial months.

Payments are processed securely by Stripe. EarlyBirder does not store your credit card information. By subscribing, you agree to Stripe's terms of service at stripe.com/legal.

4. Listing Accuracy and Disclaimer

Listings displayed on EarlyBirder are sourced from Craigslist and are provided for informational purposes only. EarlyBirder makes no representations or warranties regarding the accuracy, completeness, availability, or legitimacy of any listing.

You acknowledge that:

• Listings may be expired, inaccurate, fraudulent, or unavailable by the time you view them
• EarlyBirder is not responsible for any rental transactions, disputes, or interactions between users and landlords
• You should independently verify any listing before making payments or entering agreements
• EarlyBirder does not guarantee that Early Bird Alerts will capture every matching listing

5. Acceptable Use

You agree not to:

• Scrape, crawl, or systematically extract data from EarlyBirder
• Use the Service for any commercial purpose without our written consent
• Attempt to circumvent any access controls or security measures
• Share your account credentials with others
• Use the Service to harass, defraud, or harm others
• Violate any applicable laws or regulations

6. Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or abuse the Service. In the event of termination for cause, no refund will be issued.

7. Intellectual Property

All content, design, code, and branding on EarlyBirder — excluding third-party listing content — is the property of EarlyBirder and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Limitation of Liability

To the fullest extent permitted by law, EarlyBirder and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to losses arising from reliance on listing information, missed rental opportunities, or fraudulent listings.

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 30 days preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in California.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the site. Continued use of the Service after changes constitutes acceptance of the updated Terms.
